Bundle Campaign Terms

The Campaign is run by the participating brand identified in the campaign materials. Badges are issued, and all Reward Distribution Events are conducted, by Bundle Limited, a company incorporated in the Abu Dhabi Global Market with company number 32063 (Bundle). Once you claim your Badge, your relationship in respect of that Badge is with Bundle alone. The participating brand has no involvement in, and no responsibility for, your Badge, its Floor Value, the Reward Distribution Events or any payment made to you.

Complete the qualifying action stated in the campaign materials. Every person who completes the qualifying action and meets the eligibility conditions at section 3 receives a Badge. There is no selection and no element of chance at this stage. Everyone who qualifies receives the same Badge.

You will receive an email inviting you to claim your Badge. To claim it you must create a Bundle account and accept the Bundle End User Terms and Conditions. Your Badge is a digital record held on a public, independently verifiable and tamper-evident ledger.

To earn a Badge under this Campaign you must be an individual, resident in Singapore, and at least 18 years of age, or older where the goods or services promoted may not lawfully be purchased at 18. Employees of the participating brand and of Bundle, and their immediate families, are not eligible. Bundle may cancel a Badge issued to a person who was not eligible to earn it. Separate rules apply to a Badge you receive as a gift from another holder, and those rules are set out in the Bundle End User Terms and Conditions.

Every Badge is redeemable, and everyone who redeems receives a payment. The amount you receive is the Floor Value, and it is determined at the moment you redeem.

The amount is not decided by chance. Before you confirm a redemption, Bundle shows you the exact amount you will receive, so you always know what you are getting before you decide. You may redeem at any time from the moment you claim your Badge until the reward distribution day as stated on the Bundle website (https://www.joinbundle.com).

If you redeem, Bundle pays you that amount through a licensed payment service provider to the account you nominate. The Redemption Period ends at the cut-off time published on the Reward Distribution Event page, being the cut-off for the next Reward Distribution Event at which your Badge is eligible for selection. A Badge which has not been redeemed by that cut-off, and which is not bought back at that event, lapses and carries no value afterwards.

You do not have to redeem straight away. If you keep your Badge, it remains redeemable at any time up to the cut-off at the Floor Value applicable when you redeem, and it also becomes eligible for the Reward Distribution Event described at section 6. You never pay anything to keep a Badge. You should note that if you do not redeem before the cut-off, and your Badge is not bought back at the event, it lapses under section 4.

At a Reward Distribution Event, Bundle selects Badges and offers the holders of the selected Badges an Enhanced Buy-Back, which is an amount above the Floor Value. Selection involves an element of chance.

Reward Distribution Events are conducted by Bundle at platform level. Enhanced Buy-Backs are not allocated by reference to any single campaign or participating brand. Every eligible Badge, whichever campaign it was issued under, is eligible for selection on the same basis.

The following is the material information about the event at which your Badge is eligible.

Nothing. You do not pay Bundle to receive a Badge, to keep a Badge, to be eligible for a Reward Distribution Event or to redeem. Where the qualifying action is a purchase from the participating brand, you pay only the ordinary price of what you bought. The price is not increased to reflect this Campaign.

A Badge is a promotional reward. It is not a payment instrument, not a currency, not a security, not a unit in a collective investment scheme and not any other kind of investment product. A Badge may only be redeemed or bought back by Bundle. It cannot be sold, listed or traded on any exchange or secondary market and it is not accepted by anyone as a means of payment. Bundle makes no representation as to the amount for which a Badge will be redeemable at any future time, and no amount is promised or guaranteed in advance of redemption.

By taking part in the Campaign you confirm that: the information you give to the participating brand and to Bundle is true, accurate, complete and current; you meet the eligibility conditions at section 3; you are taking part on your own behalf and not for anyone else; you completed the qualifying action lawfully and genuinely; and you will comply with these Campaign Terms, with the Bundle End User Terms and Conditions once you accept them, and with applicable law.

You are responsible for keeping your Bundle account, your login details, your registered email address, your device and your nominated payment details secure and current. Bundle communicates with you using the contact details on your account, and is not responsible for a notification you do not receive because those details are out of date or because you did not check them.

You must not: create or use more than one account, or use another person’s account or details, in order to obtain more Badges than you are entitled to; give false, inaccurate, incomplete or misleading information; claim or attempt to claim a Badge intended for someone else; interfere with, manipulate or attempt to influence the Bundle platform, the issuance or redemption of Badges, or the conduct or outcome of a Reward Distribution Event; use any automated tool, bot, script or similar method to take part; sell a Badge, offer a Badge for sale, or accept payment for a Badge from anyone other than Bundle; take part in any fraudulent, abusive, deceptive or unlawful conduct in connection with the Campaign; or do anything which may damage Bundle, the participating brand, other participants or the integrity of the Campaign.

Bundle or the participating brand may disqualify you, refuse to issue a Badge, or cancel a Badge already issued, if you do anything described at section 10, if you did not meet the eligibility conditions at section 3, or if you otherwise breach these Campaign Terms or applicable law.

Bundle may also reverse or invalidate the issuance of a Badge where the information supplied by the participating brand about your eligibility is found to be incorrect, duplicated, fraudulent or the result of a system error or security incident, or where Bundle reasonably suspects that a Badge was obtained improperly. Where Bundle does so it will tell you and, where the position is later resolved in your favour, will reinstate the Badge or make an equivalent payment.

Bundle may take any step reasonably necessary to protect the integrity of the Campaign, including suspending an account, withholding a payment pending investigation, recovering an amount paid in error, and reporting unlawful conduct to the appropriate authority.

If your complaint is about the goods or services you bought, about the qualifying action, or about whether you completed it, that is a matter for the participating brand and you should contact it using the details in the campaign materials. The participating brand decides whether you completed the qualifying action, and Bundle acts on what the participating brand tells it.

If your complaint is about your Badge, a redemption, a transfer, your account or a Reward Distribution Event, contact Bundle at [email protected]. Bundle will acknowledge within five business days.

You may be asked to provide records supporting your complaint, such as a receipt, an order confirmation, a screenshot or correspondence. Where a complaint concerns the participating brand, Bundle may refer it to that brand and give reasonable administrative assistance without taking responsibility for resolving it. Raising a complaint with Bundle does not mean Bundle is responsible for the Campaign or for the participating brand’s goods or services. Nothing in this section affects any right you have to complain to a competent authority.

Bundle collects and uses your personal data in accordance with the Personal Data Protection Act 2012. Bundle needs your data to verify your eligibility, to issue and administer your Badge, to make payments to you, and to meet its record keeping and regulatory obligations. Bundle may disclose your data to its payment service provider, to its identity verification provider, to an independent scrutineer and to the Gambling Regulatory Authority or another regulator where required. Bundle does not disclose your personal data to the participating brand unless you have separately agreed to that. Bundle operates the platform and conducts the Reward Distribution Events. It does not manufacture, distribute, import, sell or supply the goods or services promoted by the participating brand, and is not responsible for their quality, safety, description or fitness for purpose, or for anything the participating brand says about them.

To the extent permitted by law, neither Bundle nor the participating brand is liable to you for: your failure to comply with these Campaign Terms; information you gave which was inaccurate, incomplete or out of date; unauthorised use of your account, email address, device or payment details; system downtime, maintenance, technical error, connectivity failure or delay outside its reasonable control; the acts or omissions of a third-party service provider, including a payment service provider or identity verification provider; or any event of force majeure.

If the participating brand’s systems do not record your qualifying action, or the qualifying action is unavailable through its website, application or point of sale, that is a matter between you and the participating brand and Bundle is not liable for it.

Nothing in these Campaign Terms excludes or limits any liability which cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or under the Consumer Protection (Fair Trading) Act 2003.

Bundle may suspend, modify, cancel or bring forward the end of a Campaign or a Reward Distribution Event where: it cannot be conducted as intended because of fraud, technical failure, system error, a security incident or an event outside Bundle’s reasonable control; continuing would breach applicable law, the conditions of the class licence described at section 17, or a direction of a regulator or court; the integrity or proper conduct of the Campaign or the event has been compromised; or there is a material error or dispute affecting the Campaign, the issuance of Badges or a redemption.

Where that happens, every Badge already issued remains redeemable in accordance with section 4 for the balance of the Redemption Period, and Bundle will publish notice of the change on the Reward Distribution Event page.

Neither Bundle nor the participating brand is liable for any delay or failure to perform caused by an event outside its reasonable control, including act of God, natural disaster, epidemic or pandemic, war, terrorism, civil unrest, industrial action, cyberattack, failure of internet or telecommunications infrastructure, failure of a third-party service provider, or act of a government or regulator. The affected party will use reasonable efforts to mitigate the effect of the event.

Reward Distribution Events are conducted by Bundle Limited under the class licence for trade promotion games and lotteries conferred by Part 3 of the Gambling Control (Trade and Other Promotional Games and Lotteries - Class Licence) Order 2022. That class licence applies automatically by operation of law. No permit or approval is required and none has been applied for. Nothing in this Campaign has been approved, endorsed or authorised by the Gambling Regulatory Authority or by any other Singapore authority. Bundle conducts every Reward Distribution Event in accordance with the conditions of that class licence, including the attendance of an independent scrutineer at every event.

Badge

means the digital record issued to you through the Bundle platform when you complete the qualifying action, held on a public, independently verifiable and tamper-evident ledger.

Campaign

means the promotional campaign run by the participating brand through the Bundle platform, the particulars of which are published in the campaign materials.

Campaign materials

means the advertisements, posts, mailers, landing pages, posters, banners and other materials issued by the participating brand for the Campaign.

Enhanced Buy-Back

means an amount above the Floor Value offered by Bundle to the holder of a Badge selected at a Reward Distribution Event.

Floor Value

means the amount for which a Badge may be redeemed, determined at the point of redemption in accordance with section 4 and displayed to you before you confirm.

Recipient

means a Badge holder selected at a Reward Distribution Event to receive an offer of an Enhanced Buy-Back.

Redemption Period

means the period beginning when you claim your Badge and ending at the cut-off published on the Reward Distribution Event page.

Reward Distribution Event

means an event conducted by Bundle at which Badges are selected by a verifiable random function for an offer of an Enhanced Buy-Back.

Reward Distribution Event page

means the page at https://joinbundle.com/draw/ on which the particulars of each event are published.

Bundle may amend these Campaign Terms where required by law or by a regulator, or to correct an error, and will publish the amended version at the same address. These Campaign Terms are governed by Singapore law and the Singapore courts have jurisdiction. A person who is not a party has no right under the Contracts (Rights of Third Parties) Act 2001 to enforce any of these terms. If any provision is held to be invalid or unenforceable, it is severed and the remainder continues in force. A failure or delay by Bundle in exercising a right is not a waiver of it.

By completing the qualifying action, claiming a Badge, redeeming a Badge or taking part in a Reward Distribution Event, you confirm that you have read, understood and agreed to these Campaign Terms and to the particulars published in the campaign materials and on the Reward Distribution Event page.
